Bannister Mansfield and FPA settle proceedings
An unreserved apology by Bannister Mansfield Financial Services director Gavin Murphy to the Financial Planning Association (FPA) has put an end to legal proceedings between the two groups.
The FPA announced late on Thursday that legal proceedings it had been obliged to commence in the Federal Court in response to allegedly misleading and deceptive advertisements placed by Bannister Mansfield had been resolved between the parties by confidential terms of settlement.
It said in February, the FPA had been successful before the court in obtaining interim injunctive relief and since that time had pursued final injunctive relief together with costs and damages.
It said Murphy had now made an unreserved apology for his actions in publishing the advertisements and had stated his deep regret for the anguish caused by the advertisements to representatives of the FPA.
It said the proceedings had yesterday been resolved between the parties and by the court, by consent, making orders restraining the further publication of the relevant advertisements and like material.
